These Terms of Service ("Terms") are a legal agreement between you and GMT Consulting LLC ("Evenia", "we", "us") governing your use of the Evenia application and website at https://evenia.app (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your login credentials secure and for all activity under your account.
Evenia is a guided, personalized manifestation and journaling practice: daily sessions, personalized affirmations and scripts, programs, reminders, a progress and "evidence" log, personalized audio and a personal vision board. The Service supports a personal mindset practice. It is not medical, psychological, financial or legal advice, and we do not promise or guarantee any particular outcome or result. Your results depend on many factors outside our control.
You keep ownership of the content you create (journal entries, affirmations, goals, uploads, etc.) ("Your Content"). You grant us a limited licence to host, process and display Your Content solely to operate and provide the Service to you (including sending it to our AI and audio providers to generate your personalized content). You are responsible for Your Content and confirm you have the right to upload it. You must not upload illegal content or content that infringes others' rights.
Parts of the Service generate text and audio using artificial intelligence based on the information you provide. AI output can be inaccurate or unexpected and is provided "as is" for personal, reflective use only. You are responsible for how you use it.
You agree not to: misuse or disrupt the Service; attempt to access other users' data; reverse engineer, copy or resell the Service; use it for unlawful purposes; or share your paid account to circumvent subscription fees. We may suspend or terminate accounts that violate these Terms.
Free tier / trial. We may offer a free tier and a 7-day free trial of Premium. If you do not cancel before the trial ends, the subscription you selected starts automatically and the applicable fee is charged.
Prices. Premium is $14.90 per month or $149 per year (prices may vary by country, taxes and currency, and may change with notice as described below). Applicable taxes (e.g. VAT) may be added.
Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price, using your payment method on file, until you cancel.
Payment. Payments are processed by Stripe. By subscribing you authorize us (via Stripe) to charge your payment method for the subscription and renewals.
Cancellation. You can cancel at any time from your account settings or via the Stripe customer portal. Cancellation stops future renewals; you keep Premium access until the end of the current paid period.
Price changes. We may change prices. We will notify you in advance, and changes apply to the next renewal; you can cancel before then if you do not accept the new price.
EEA/UK consumers. You normally have a 14-day right of withdrawal for digital services. By starting to use the Service during this period you may agree that performance begins immediately and acknowledge that your right of withdrawal is lost once the service has been fully performed; where it is only partly performed you may owe a proportionate amount.
Elsewhere. Except where required by law, payments are non-refundable and there are no refunds for partial periods. We may, at our discretion, offer a refund (for example, promptly after an accidental renewal) — contact support@evenia.app.
We may issue promotional or gift codes that grant Premium for a limited time. Codes have no cash value, cannot be combined unless stated, and may expire. We may void codes obtained fraudulently.
The Service, including its software, design, content, programs and trademarks (but excluding Your Content), belongs to GMT Consulting LLC or its licensors and is protected by law. We grant you a limited, personal, non-transferable, non-exclusive licence to use the Service while your account is in good standing.
The Service relies on third parties (e.g. Supabase, Stripe, our AI, audio and email providers). We are not responsible for their services, and their terms may also apply.
The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any outcome will be achieved. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
To the maximum extent permitted by law, GMT Consulting LLC will not be liable for indirect, incidental, special or consequential damages, or loss of data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or for fraud). Consumers retain all mandatory statutory rights.
You can delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. IP, disclaimers, limitation of liability) will survive.
We may update these Terms. We will post the updated version with a new date and, for material changes, notify you. Continuing to use the Service after changes take effect means you accept them.
These Terms are governed by the laws of the United States and the state where GMT Consulting LLC is organized, without regard to conflict-of-law rules. If you are a consumer, you may also benefit from the mandatory protections of the country where you live.
